Please read these terms carefully before using MyOwnPA. By registering for or using the service, you agree to be bound by these terms. If you do not agree, please do not use the service.
1. Definitions
- "MyOwnPA" means the AI-powered personal assistant platform operated by My Own PA (Pty) Ltd
- "Company" means My Own PA (Pty) Ltd, a South African registered company
- "User" means any individual or entity that registers for and uses the MyOwnPA service
- "Service" means the MyOwnPA platform, including all features accessed via WhatsApp
- "Content" means any data, text, voice notes or information submitted by the User through the Service
- "Vertical" means a specific product configuration of MyOwnPA tailored to a particular industry or use case
- "AI-Generated Content" means any text, document, presentation, quote, invoice or other output produced by the Service using artificial intelligence
- "Third-Party Platforms" means external services on which the Service depends, including but not limited to messaging infrastructure, cloud storage and productivity services, and AI processing services
- "Platform Outage" means any interruption, degradation, or unavailability of a Third-Party Platform, whether scheduled or unscheduled, that affects the delivery of the Service
2. The Service
MyOwnPA is an AI-powered personal assistant that operates via WhatsApp. The Service allows Users to manage tasks, calendar events, contacts, expenses, emails and other business functions through voice notes and text messages across the following verticals: MyOwnPA Home, MyOwnPA Trades, MyOwnPA Guesthouse, and MyOwnPA SME Owner, with additional verticals added from time to time.
What the Service does
- Interprets your voice notes and text messages to identify your intent
- Takes actions on your behalf such as sending emails, creating calendar events, generating quotes, invoices and presentations, and logging data
- Stores your data in a private workspace within the Company's controlled environment
- Delivers responses and automated messages via WhatsApp in reply to your messages
- Transcribes voice notes to text using a third-party voice transcription service
- Communicates with third parties (clients, staff, guests, suppliers) on your behalf when instructed
What the Service does not do
- The Service is not a substitute for professional legal, financial, medical or accounting advice
- The Service does not guarantee that AI-Generated Content is error-free or appropriate for all purposes
- The Service does not access your phone contacts or any personal data beyond what you explicitly share with it
- The Service does not initiate WhatsApp conversations with you — you must always send the first message to begin a session
3. WhatsApp Opt-In and Communication Consent
By registering for MyOwnPA and providing your WhatsApp number, you explicitly consent to the following:
- You are the owner or authorised user of the WhatsApp number you have provided
- You consent to receiving WhatsApp messages from MyOwnPA in response to messages you send to us
- You understand that MyOwnPA uses artificial intelligence to process your messages and generate responses on your behalf
- You authorise MyOwnPA to send WhatsApp messages and emails to third parties (including your clients, staff, guests and suppliers) on your instruction
- You warrant that any third party you instruct MyOwnPA to contact has provided you with consent to be contacted
- You may withdraw your consent at any time by sending "STOP" to our WhatsApp number or by contacting us at support@myownpa.app
MyOwnPA will only message you in response to messages you initiate. We will never send you unsolicited business-initiated messages. All communication from MyOwnPA occurs within the 24-hour session window opened by your message to us, in accordance with Meta's WhatsApp Business Messaging Policy.
4. Financial Disclaimer
⚠️ MyOwnPA is not a registered financial services provider, accountant or tax practitioner. The features below are organisational tools only — not financial advice.
MyOwnPA provides tools for logging, tracking and organising financial information including expenses, receipts, budgets, quotes and invoices. By using these features you acknowledge that:
- Budget tracking and expense logging features record information you provide — they do not verify, audit or validate financial data
- Receipt scanning extracts information from images using AI — accuracy must be verified by the User
- Quotes and invoices generated by the Service are based on information you provide — the Company bears no liability for errors in pricing or calculations
- Tax calculations, VAT amounts and SARS compliance are the sole responsibility of the User and their appointed accountant
- The Company bears no liability for any financial loss, tax liability or penalty arising from reliance on data processed or generated by the Service
You are strongly advised to have all financial documents generated by MyOwnPA reviewed by a qualified accountant before use.
5. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate content including task lists, email drafts, meeting agendas, presentation slides, quotes, invoices, meeting transcriptions and client briefs. By using these features, you acknowledge that:
- AI-Generated Content may contain errors, inaccuracies or omissions
- AI-Generated Content is not reviewed by a human before delivery to you
- You are solely responsible for reviewing all AI-Generated Content before using, sending or relying on it
- Meeting transcriptions are generated automatically and may contain errors
- The Company bears no liability for any loss arising from reliance on AI-Generated Content without independent verification
6. Third-Party Communications
Certain verticals of the Service enable MyOwnPA to send communications to third parties on your behalf. By instructing MyOwnPA to send such communications, you warrant that:
- You have the legal authority to send those communications on behalf of yourself or your business
- The recipients have consented to receive communications from you via the relevant channel
- The content complies with all applicable laws including the Electronic Communications and Transactions Act and POPIA
- You will not use the Service to send spam or unsolicited bulk communications
The Company bears no liability for the content, legality or consequences of third-party communications sent on your instruction.
7. Voice Note Processing and Meeting Recording
The Service processes voice notes you send via WhatsApp by transcribing them to text using a third-party voice transcription service. By using the meeting recording feature, you warrant that:
- You have informed all meeting participants that the meeting is being recorded
- All participants have consented to the recording and transcription of the meeting
- The recording complies with all applicable laws in your jurisdiction
The Company bears no liability for any legal consequence arising from the unauthorised recording of meetings.
The Service is built on and depends upon Third-Party Platforms operated by independent companies. The availability, performance and continued operation of the Service is directly contingent on these platforms functioning correctly.
By using the Service, you acknowledge and agree that:
- The Company has no control over Third-Party Platforms and cannot guarantee their availability, security or continued operation
- Third-Party Platforms may change their terms of service, pricing, features or APIs at any time, which may affect the Service
- The Company may be required to modify, suspend or discontinue features of the Service as a result of changes to Third-Party Platforms, with or without notice
- The Company bears no liability for any loss, inconvenience or damage caused by the unavailability, degradation or discontinuation of any Third-Party Platform
- Messages sent to MyOwnPA during a Platform Outage may not be processed and will not be queued for later processing unless explicitly stated
- You are responsible for re-sending any time-sensitive instructions that were not processed due to a Platform Outage
9. Service Interruptions and Force Majeure New
The Company strives to provide a reliable and consistent service but does not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:
- Outages or degraded performance on any Third-Party Platform (including WhatsApp, Google, or Anthropic)
- Scheduled or emergency maintenance by the Company or any Third-Party Platform
- Network connectivity issues, internet service provider failures, or infrastructure disruptions
- Cyberattacks, security incidents or DDoS events affecting the Service or any Third-Party Platform
- Acts of God, natural disasters, government action, or any other circumstances beyond the Company's reasonable control
- Changes in applicable law or regulation that require the Service to be modified or suspended
The Company shall not be liable for any direct, indirect, incidental or consequential loss or damage arising from any service interruption, regardless of the cause. This includes but is not limited to:
- Loss of business, revenue or profits due to inability to access the Service
- Missed deadlines, appointments or commitments caused by Service unavailability
- Unprocessed instructions or data not captured during an outage period
- Delays in email delivery, quote generation, invoice sending, or any other Service function
Where a force majeure event prevents the Company from delivering the Service for a continuous period exceeding 30 days, either party may terminate the subscription with written notice and the Company will refund any prepaid subscription fees for the affected period on a pro-rata basis.
The Company will make reasonable efforts to communicate Platform Outages and service interruptions to active subscribers via the MyOwnPA website (myownpa.app) and, where the WhatsApp channel is functional, via WhatsApp notification.
10. Registration and Account
To use MyOwnPA you must register with a valid WhatsApp number, full name and email address. You must be at least 18 years of age. You are responsible for all activity that occurs through your WhatsApp number in connection with the Service.
11. Subscription and Payment
MyOwnPA is offered on a monthly subscription basis. Pricing is displayed at myownpa.app. All prices are inclusive of VAT unless otherwise stated. Subscriptions are billed monthly in advance via Stripe. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months, except as provided in clause 9 above in relation to extended force majeure events.
12. Fair Use and Usage Limits
Daily and monthly usage limits apply per subscription tier. If you reach a limit, the Service will notify you via WhatsApp. Details of current limits are available at myownpa.app.
13. Acceptable Use
You agree not to use the Service to send spam, violate any applicable law, infringe intellectual property rights, transmit harmful content, reverse engineer the Service, use it on behalf of another person without their consent, or violate WhatsApp's Terms of Service or Meta's WhatsApp Business Messaging Policy.
14. Your Content
You retain ownership of all content you submit through the Service. By using the Service, you grant My Own PA (Pty) Ltd a limited licence to process your content solely for the purpose of providing the Service to you. You are solely responsible for the accuracy and legality of all content you submit.
15. Intellectual Property
All intellectual property rights in the MyOwnPA platform, including the software, branding, website and documentation, are owned by My Own PA (Pty) Ltd. Nothing in these terms grants you any rights in our intellectual property.
16. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that any specific feature will be available at any given time. The Company expressly disclaims any warranties relating to the availability, accuracy, or reliability of Third-Party Platforms. To the maximum extent permitted by South African law, we disclaim all warranties including implied warranties of merchantability and fitness for a particular purpose.
17. Limitation of Liability Updated
To the maximum extent permitted by law, My Own PA (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including but not limited to:
- Loss of business, revenue, data, goodwill or anticipated savings
- Any loss arising from Platform Outages or Third-Party Platform failures
- Any loss arising from reliance on AI-Generated Content
- Any loss arising from unprocessed instructions during a service interruption
- Any loss arising from delays in message delivery or processing
Our total aggregate liability to you for all claims arising under or in connection with these terms shall not exceed the total subscription fees paid by you in the one calendar month immediately preceding the event giving rise to the claim.
Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded under South African law.
18. Termination
We reserve the right to suspend or terminate your access immediately and without notice if you breach these terms or engage in fraudulent activity. Your data will be handled in accordance with our Privacy Policy upon termination.
19. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via WhatsApp at least 14 days before they take effect. Continued use of the Service constitutes acceptance of the updated terms.
20. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
